• Trading performance is evaluated based on objective metrics as outlined in your account dashboard
• Violation of trading rules may result in disqualification from challenges or termination of funded accounts
• ACM Funded reserves the right to modify challenge parameters and funded account terms with reasonable notice

4. Payouts and Profit Sharing

Profit sharing and payout terms are subject to the following conditions:

• Profit splits are determined by your account type and may be subject to scaling plans as you demonstrate consistent performance
• Payout requests must meet minimum thresholds and are processed according to the schedule published on our platform
• All payouts are subject to verification of trading activity and compliance with our trading rules
• ACM Funded reserves the right to withhold payouts in cases of suspected rule violations or fraudulent activity

5. Prohibited Activities

The following activities are strictly prohibited and may result in immediate termination of your account:

• Manipulative trading practices or attempts to exploit platform vulnerabilities
• Use of unauthorized trading algorithms or expert advisors
• Sharing account access with unauthorized users
• Attempting to reverse-engineer or disrupt our platform
• Engaging in any illegal activities or using our platform for unlawful purposes
• Creating multiple accounts to circumvent trading rules or limitations

6. Intellectual Property

The content, features, and functionality of the ACM Funded platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are the exclusive property of ACM Funded or its content suppliers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Limitation of Liability

In no event shall ACM Funded, its officers, directors, employees, or agents be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of our platform, services, or content, whether based on contract, tort, strict liability, or otherwise, even if ACM Funded has been advised of the possibility of damages. This limitation applies to damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, destruction, or unauthorized access to, alteration of, or use of records.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
